REGULATIONS OF THE CATALOGUE OF STELMET PRODUCTS

 

1. [definitions]

The terms used in the Regulations of the Catalogue Stelmet mean:

• Regulations - these regulations of the Catalogue of Stelmet Products, available in the public domain on the Internet at https://katalog.stelmet.com/regulamin;

• Stelmet - a company under the name Stelmet S.A. with the registered seat in Zielona Góra, at ul. Gorzowska 20, entered into the Register of Entrepreneurs kept by the District Court in Zielona Góra, 8th Commercial Division of the National Court Register under KRS [National Court Register:] number: 0000572297, with the Tax Identification Number: 9730679032, e-mail address: stelmet@stelmet.com, being the owner of the Catalogue of Stelmet Products;

• Catalogue of Stelmet Products, Website – an Internet service used to provide the services by Stelmet electronically;

• User - an entrepreneur  having an Account in the service established by registration and acceptance of the Regulations, on the basis of which he/she obtained access to electronic services provided by Stelmet;

• Account - an account in the IT system kept for the User by Stelmet, available to the User after logging in;

• Contract for provision of the electronic services - an agreement concluded between the User and Stelmet on the terms specified in the Regulations;

• Entrepreneur - an entrepreneur within the meaning of art. 4 of the 6 March 2018 Act -  Entrepreneurs' Law (Journal of Laws, item 646);

• Request for proposal – an invitation of Stelmet to submit a delivery/sale offer for the indicated product; a request for proposal is not an order;

• Inquiry Basket - a list of products selected by the User, available after logging in, before submitting the Request for Proposal;

• Business days - days from Monday to Friday, excluding public holidays.

2. [general provisions]

2.1. The Regulations define the rules for use of the Catalogue of Stelmet Products and related rights and obligations of Users as well as the conditions for provision of electronic services by Stelmet.

2.2. To use the electronic services provided by Stelmet, it is necessary to familiarize with the Regulations and accept their all provisions.

2.3. Using the Catalogue of Stelmet Products requires the User to use the software in the form of the current version of the web browser with the application of cookies and JavaScript.

3. [electronic services provided by Stelmet]

Stelmet, as the administrator of the website, provides its Users with electronic services that enable viewing products in its sales offer and submitting Requests for Proposals for  products presented on the Website as well as provides other services specified in the Regulations, in particular regarding the registration and administration of the Account.

4. [Catalogue of Stelmet Products]

4.1. All products presented on the website are new.

4.2. The information included on the website does not constitute an offer within the meaning of art. 66 of the Civil Code, it constitutes only an invitation to submit a Request for Proposal within the meaning of art. 71 of the Civil Code, particularly,  Stelmet does not guarantee availability of products in the quantity declared by the User.

5. [creating an Account]

5.1. Creating an Account requires registration, consisting of filling out the form located on the page: https://katalog.stelmet.com/panel,register in the "Register an account" tab and clicking the activation link sent to the e-mail address provided by the User.

5.2. The User may not use other Users' Accounts and make his/her Account available to unauthorized persons. In order to secure access to the Account, the User sets up an access password when registering. Stelmet is not responsible for activities performed by unauthorized persons falling under the scope of User Account management.

5.3. The User may only be an Entrepreneur.

5.4. User registration and submission on behalf of and for him/her any statements of will and knowledge in an electronic form within the User's Account may only be made by a duly authorized natural person with full legal capacity.

5.5. As a result of the proper registration, Stelmet creates an Account for the User.

5.6. When the Account is created between Stelmet and the User, an Contract for provision of electronic services is concluded under specific conditions in the Regulations. The contract for provision of electronic services is concluded for an indefinite period.

5.7. The User is obliged to update any data included in his/her Account each time it is changed, for this purpose he/she sends the updated data to the following e-mail address:

katalog-stl@stelmet.com.

5.8. Removal of the Account, and thus termination of the contract for provision of electronic services, requires sending a request to remove the Account from the e-mail address provided at the Account registration to the following e-mail address katalog-stl@stelmet.com.

6. [submitting Requests for Proposal]

6.1. To familiarize with the offer of the Catalogue of Stelmet Products, the product search module is used.

6.2. The description of products includes, among others, designation of the packaging method and the number of packaged products. Requests for Proposal may refer only to one or multiple of the packing unit specified for a given product (pallet, joist, box or other collective packaging).

6.3. The product is chosen by selecting the logged-in option ‘Add to requests for proposal’ by the User after specifying its quantity. The product will then be added to the virtual inquiry basket and the system will go to the basket contents where you can update the product quantity by entering the desired number of packing unit.

6.4. After completing the Inquiry Basket, the User submits an inquiry by clicking in the ‘Send a request for proposal’ icon after completing the delivery country and postal code.

6.5. Submission of the Request for Proposal is tantamount to an invitation by Stelmet to submit a delivery/sale offer for the indicated product.

6.6. Information about the Request for Proposal sent is automatically sent by the Website to the Stelmet Sales Department. A representative of the Stelmet Sales Department makes contact by phone or email at the e-mail address or phone number provided by the User in order to determine the details of the offer Stelmet (delivery date, delivery method, payment terms), to which the User agrees. The contact from the Stelmet Sales Department takes place on Working Days.

6.7. Placing an offer by Stelmet, its acceptance by the User and conclusion of the  contract for the delivery/sale of products occur outside the website of the Catalogue of Products Stelmet.

6.8. The offer is submitted electronically to the e-mail address provided by the User when registering the Account.

6.9. In the offer Stelmet will indicate the date of being binding with the offer. Art. 661 of the Civil Code does not apply to the contracts concluded on the basis of the offer submitted by Stelmet.

7. [protection of personal data]

Stelmet processes personal data of Users and their representatives on the basis of applicable law and the Privacy Policy placed on the Website.

8. [rights and obligations of the User]

8.1. The User is obliged to use the Catalogue of Stelmet Products in accordance with applicable law and the provisions of the Regulations.

8.2. Users are prohibited from placing unlawful content on the site.

8.3. All activities aimed at disrupting the proper operation of the website are prohibited.

8.4. Users are solely responsible for any damage caused as a result of their unlawful behaviour and the provisions of the Regulations.

9. [complaints regarding provision of the electronic services]

9.1. Complaints related to provision of the electronic services by Stelmet may be submitted:

-  in writing to Stelmet;

- in an electronic form to the following address: katalog-stl@stelmet.com.

9.2. The complaint should contain:

- a description of the subject of the complaint, in particular the type, circumstances and indication of the date of occurrence of the irregularity;

- contact details of the person making a complaint.

9.3. Stelmet shall consider the submitted complaint immediately, however not later than within 14 (fourteen) days from the date of its submission. The response to the complaint will be sent via the same means of communication as it was submitted.

9.4. The use of non-judicial means of dealing with complaints and pursuing claims is voluntary.

10. [final provisions]

10.1. Regulations come into force on 14_11_2018.

10.2. Stelmet reserves the right to change the provisions of the Regulations. In the event of making amendments to the Regulations, Stelmet shall provide a uniform text of the Regulations by publishing on the website https://katalog.stelmet.com/regulamin  and by means of a message sent to the e-mail address provided during registration by the User, which is unambiguous with the introduction of information about the change to the means of electronic communication in such a way that the User can become familiar with its content. The change of the Regulations comes into force after 14 (fourteen) days from the date of sending the information. Users have the right to terminate the Contract for provision of the electronic services within 14 (fourteen) days from the date of notifying them of the change in the Regulations.

10.3. In matters not covered by the Regulations, the Polish law applies.

10.4. All rights to the content of the Catalogue of Stelmet Products are reserved for Stelmet.
